Supreme Court Halts Bulldozer Operations: Maulana Madani Calls It a Victory for Justice and Constitutional Rights
New Delhi, September 17: In a significant move, Jamiat Ulama-e-Hind President Maulana Mahmood Madani welcomed the Supreme Court’s decision to temporarily halt bulldozer operations, stating that the increasing portrayal of bulldozers as symbols of justice is a grave violation of constitutional rights. Madani applauded the court’s stance, emphasizing that the judicial process must remain supreme and cannot be undermined by such measures or reckless statements made by government ministers.
The Supreme Court, responding to a petition filed by Maulana Mahmood Madani and Maulana Niyaz Ahmad Farooqui, issued a nationwide interim stay on bulldozer actions until October 1, 2024. The court clarified that this stay does not apply to public infrastructure encroachments, such as roads and railway lines. Justices BR Gavai and KV Viswanathan highlighted that demolishing homes as punishment is unacceptable.
Court Criticizes Ministers’ Statements
The bench expressed displeasure over statements made by Union ministers advocating the continued use of bulldozers, despite the court’s prior order. Justice Gavai questioned whether such rhetoric should be allowed, while Justice Viswanathan affirmed the need for nationwide guidelines to prevent misuse of power by local authorities.
Guidelines Proposed by Jamiat Ulama-e-Hind
Jamiat Ulama-e-Hind proposed a series of guidelines to ensure transparency and accountability in demolition practices, including mandatory written notices, surveys, and penalties for non-compliant officials. These recommendations are aimed at safeguarding constitutional rights and preventing arbitrary demolitions.
The court has scheduled the next hearing for October 1, where the future of bulldozer operations will be deliberated further.
